Acceptance of Terms

By accessing or using the 1STBOND mobile application and related services (the "Services"), you agree to be legally bound by these Terms of Service ("Terms"). These Terms constitute a binding agreement between you and 1STBOND, LLC ("1STBOND," "we," "our," or "us").

If you do not agree, you must not use the Services.

Eligibility

To use the Services, you must meet all of the following requirements:

Be at least 16 years of age
Have the legal capacity to enter into a binding agreement
Provide accurate information
Complete required identity verification
Not be previously suspended or banned from the Services

If you are under 16, you represent that you have parental or legal guardian consent where required by law. This requires the parent or legal guardian to also agree to these Terms and the Privacy Policy.

Identity Verification

Participation in meetups and certain payment features requires:

Submission of government-issued identification
Completion of meetup-time face verification
Explicit consent from both parties
Verification confirms identity at the time of verification only — it does not guarantee behavior, character, or safety. 1STBOND reserves the right to approve, deny, suspend, or revoke verification at its discretion.

Biometric Acknowledgment

By submitting identity verification materials, including facial images, you acknowledge and consent to the use of facial comparison technology for identity verification and fraud prevention purposes, as described in our Privacy Policy.

1STBOND does not sell biometric data and does not use biometric data for advertising or profiling.

Marketplace Payments (Stripe Connect)

A. Payment Processing

1STBOND enables peer-to-peer payments through Stripe Connect. All payment processing, fund holding, KYC verification, AML compliance, chargeback handling, and payout processing are conducted by Stripe or its affiliated financial institutions. 1STBOND does not hold user funds, operate as a bank, act as a money transmitter, or provide custodial wallet services.

B. User Responsibility

Users are solely responsible for the accuracy of payment amounts, compliance with applicable laws, ensuring payment recipient accuracy, and any taxes arising from transactions. 1STBOND is not responsible for payment disputes between users.

C. Application Fees

1STBOND may charge service or application fees on transactions. Fees will be disclosed prior to transaction confirmation.

D. Disputes & Chargebacks

Payment disputes, chargebacks, and reversals are handled according to Stripe's policies and applicable card network rules. 1STBOND may deduct chargeback amounts or fees from payouts where permitted.

E. Refunds

Refunds are subject to Stripe's policies and may be granted at our discretion or where required by law.

Assumption of Risk

Users acknowledge that in-person interactions involve inherent risks including fraud, misconduct, personal injury, or criminal activity.

You voluntarily assume all risks associated with real-world meetups and related transactions. 1STBOND provides safety tools but cannot guarantee outcomes.

Panic Feature Disclaimer

1STBOND provides safety notification tools only. We are not law enforcement, an emergency dispatch provider, or a crisis response organization. We do not guarantee delivery of notifications or intervention outcomes.

For emergencies, contact 911 or your local authorities immediately. The panic feature is a supplemental safety tool, not a replacement for emergency services.

User Conduct

You agree not to engage in any of the following:

Submit fraudulent identification
Engage in illegal activity
Use payments for unlawful purposes
Misuse the panic system
Interfere with platform operations
Circumvent verification systems

Violation may result in account suspension or permanent termination.

Administrative Authority

1STBOND reserves the right to:

Suspend or terminate accounts
Remove meetups or transactions
Retain incident records
Cooperate with law enforcement
Freeze access pending investigation

We are not obligated to monitor activity but may do so at our discretion.

Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE."

We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free service.

Limitation of Liability

To the fullest extent permitted by law, 1STBOND is not liable for user conduct, in-person interactions, criminal acts, payment disputes, chargebacks, financial losses, or indirect or consequential damages.

In no event shall total liability exceed the greater of:

Maximum Liability Cap
$100 USD
or the amount paid to 1STBOND in the prior 12 months, whichever is greater.

Indemnification

You agree to indemnify and hold harmless 1STBOND and its affiliates from claims arising from:

Your conduct on or off the platform
Your misuse of the Services
Your violation of applicable law
Payment disputes or fraud involving your account

Arbitration & Class Action Waiver

All disputes shall be resolved through binding arbitration on an individual basis.

You waive the right to participate in class actions. Small claims court claims are permitted where applicable.

Governing Law

These Terms are governed by the laws of:

State of Colorado, United States

General Provisions

Severability

If any provision of these Terms is found unenforceable, the remainder continues in full force and effect.

Assignment

1STBOND may assign these Terms without restriction. Users may not assign rights or obligations without prior written consent from 1STBOND.

Modifications

We may update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
