PLEASE READ THESE TERMS CAREFULLY BEFORE USING 1STBOND. By creating an account or using the 1STBOND mobile application or website at 1st-bond.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Services. 1STBOND is a marketplace, meetup coordination, and local business discovery platform intended exclusively for users who are 18 years of age or older. It is not an identity verification service, background check service, or safety guarantee. Identity verification is optional for most users and mandatory only for Marketplace sellers. 1STBOND does not verify the age, identity, criminal history, or intentions of any user who has not affirmatively opted into identity verification, and even for users who do verify, verification confirms only that submitted documents matched a face scan — it does not guarantee safety, intent, or character.
PLAIN-ENGLISH SUMMARY (not a substitute for the full Terms below) - 1STBOND is strictly 18+. We do not independently verify your age unless you complete optional identity verification. - Identity verification (government ID + biometric face match via Didit) is optional for most users but required for Marketplace sellers. - All meetup participants must complete a mandatory pre-meetup confirmation scan — a coordination and check-in tool, not a safety feature. - The scan window opens 6 hours before and closes 10 minutes before the meetup. Reminders are sent at 6 hours, 1 hour, and 10 minutes before. - Marketplace, meetup coordination, GPS navigation, live tracking, and Business Discovery browsing are all free. - Business Profiles (Directory listings + For You feed posts) are free to create. A Business Directory Subscription (recurring fee) is available for enhanced visibility. - Business Profiles are publicly visible in-app and on the 1st-bond.com website. Creating a Business Profile does not require identity verification. - No payment processing on-platform for Marketplace transactions. Payments happen entirely offline between buyer and seller. - You assume all risk of in-person meetups. 1STBOND is not a safety service. - Most disputes go to individual binding arbitration (JAMS). You can opt out within 30 days of first accepting these Terms. - Our liability to you is capped at the greater of what you paid us in the last 12 months or $100. Note: The 1STBOND app displays simplified UI labels (e.g., "Safe, verified in-person meetings") for usability purposes. Those labels are not legal representations and do not modify these Terms, which control in the event of any conflict.
These Terms constitute a legally binding agreement between you and 1STBOND LLC governing your access to and use of the 1STBOND mobile application, the 1st-bond.com website, and all related services (collectively, the "Services").
By creating an account, browsing the website, or otherwise accessing the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated by reference.
We reserve the right to update these Terms at any time. Material changes will be communicated via in-app notification and email at least 30 days before they take effect. Simplified summaries displayed within the app or on the website do not modify these Terms, which control in the event of any conflict.
THE SERVICES ARE INTENDED EXCLUSIVELY FOR USERS WHO ARE 18 YEARS OF AGE OR OLDER. BY CREATING AN ACCOUNT, YOU REPRESENT AND WARRANT THAT YOU ARE AT LEAST 18 YEARS OF AGE. IF YOU ARE UNDER 18, YOU MAY NOT CREATE AN ACCOUNT OR USE THE SERVICES IN ANY MANNER.
To use 1STBOND, you must also:
Be a human individual (not a corporation, bot, or automated service) for personal accounts; businesses may create Business Profiles as described in Section 13
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the Services under applicable law
Not have previously been suspended or permanently removed from the Services
AGE GATE — SELF-DECLARATION 1STBOND is rated 17+ on the Apple App Store and Mature on the Google Play Store, and is intended exclusively for users 18 and older. During account creation, you are required to confirm that you are 18 years of age or older before proceeding. This confirmation is a self-declaration. 1STBOND LLC does not independently verify your age through a third-party age verification system for general users. The sole exception is Marketplace sellers, whose age is confirmed against a government-issued ID as part of mandatory seller identity verification described in Section 11.1. Misrepresenting your age during account creation is a violation of these Terms and may result in immediate account termination. 1STBOND LLC does not knowingly permit users under 18 to maintain an account and does not knowingly collect personal information from children under 13. If we become aware of either, we will terminate the account and delete associated information promptly. Parents and guardians: if you believe a minor has created an account on 1STBOND, contact us immediately at support@1st-bond.com. We will investigate and terminate the account if confirmed.
To use 1STBOND, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You may update your email, password, and username at any time in Account Settings. You may only maintain one account. Creating multiple accounts to circumvent a suspension, termination, or any platform restriction is a violation of these Terms.
1STBOND does not require identity verification to create an account, browse the Marketplace, purchase items, message other users, participate in most meetups, or create a Business Profile. Identity verification is mandatory only if you wish to create a Marketplace listing as a seller; see Section 11.1.
If you choose to complete identity verification — or are required to as a Marketplace seller — you consent to the collection and processing of your government-issued identification by Didit, our third-party identity verification provider, including your full name, date of birth, ID number, issuing jurisdiction, expiration date, and residential address. 1STBOND LLC does not store your residential address, ID number, or expiration date in our own systems. We may access full ID data from Didit only in connection with fraud investigation, a valid legal or law enforcement request, or a safety incident. Completing identity verification will display an "ID Verified" badge on your profile.
WHAT IDENTITY VERIFICATION DOES NOT MEAN Identity verification confirms only that a user submitted a government-issued ID that was matched to a face scan at the time of verification. It does NOT mean 1STBOND has conducted a background check, criminal history check, or any assessment of a user's character, intentions, or behavior. An "ID Verified" badge is not a safety endorsement.
Separately from optional identity verification, 1STBOND requires all meetup participants to complete a pre-meetup confirmation scan as a coordination and check-in tool. The scan window opens 6 hours before the meetup and closes 10 minutes before the meetup. Reminders are sent at 6 hours, 1 hour, and 10 minutes before the scheduled meetup time. If a participant does not complete the scan before the 10-minute mark, the meetup is marked Unverified. This scan is a logistics feature — not a safety or identity verification feature.
When creating a meetup, a host may toggle a "Require ID verification" setting. When enabled, only users who have completed identity verification through Didit may join that specific meetup. This setting applies only to the specific meetup for which it is set.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@1st-bond.com if you become aware of any unauthorized use.
1STBOND is rated 17+ on the Apple App Store and Mature on the Google Play Store, reflecting that the platform is intended exclusively for users 18 years of age or older. The app facilitates in-person meetups between users, contains user-generated content, and includes a peer-to-peer marketplace. These ratings are accurate representations of the platform's content and intended user base.
Both Apple and Google impose their own independent terms and requirements on users of their platforms and on transactions processed through their billing systems. Your use of 1STBOND through the Apple App Store or Google Play Store is also subject to Apple's or Google's applicable terms of service. In the event of a conflict between those platform terms and these Terms with respect to in-app purchases or App Store conduct, Apple's or Google's terms govern that specific subject matter.
In compliance with applicable App Store developer agreements and App Store Accountability Act requirements in states where such laws are in effect, 1STBOND LLC will notify Apple and Google prior to any material change to: (a) our data collection or sharing practices; (b) our monetization model; (c) our app's age rating or content classification; or (d) any feature change that would materially affect user privacy or safety. Such notifications will be made through the applicable developer portal as required by platform policy.
1STBOND is a strictly 18+ platform. We do not offer a version of the Services for users under 18, we do not provide parental controls, and we do not permit supervised or restricted access for minors. There is no mechanism for parental consent to allow a minor to use the Services. If a parent or guardian becomes aware that a minor has registered, they should contact support@1st-bond.com immediately for account removal.
The Services contain the following types of content, which informed the 17+/Mature app store age ratings:
User-generated content including photographs, videos, and text posted by users in Marketplace listings, Business Profiles, and the For You feed
In-person meetup coordination between users who may be strangers to one another
Peer-to-peer messaging between users
User ratings and written reviews
Biometric data collection (face scans) for meetup coordination and optional identity verification
1STBOND does not host, permit, or tolerate adult content, sexually explicit material, graphic violence, or content targeted at or appropriate for minors. Any user-generated content of that nature is a violation of Section 7.4 and will result in immediate account termination.
1STBOND uses automated systems in the following limited contexts within the Services:
For You feed ranking: the For You feed in the Business Discovery tab uses algorithmic ranking to surface Business Profile content to users based on proximity, category preference, and engagement signals. This ranking does not make any legal or significant decisions about users — it determines only the display order of business content within the feed.
Marketplace search and sorting: Marketplace listings may be ranked or sorted based on recency, proximity, and Promoted Listing status. This ranking does not make any legal or significant decisions about users.
Pre-meetup scan matching: AWS performs automated biometric matching between a user's live face scan and their stored account scan. This is a one-to-one matching function, not a population-wide identification system.
Identity verification: Didit uses automated document verification and biometric matching to determine whether a submitted ID matches a face scan. Users may contact support@1st-bond.com to dispute a verification outcome.
California residents have the right under California's Automated Decision-Making Technology (ADMT) regulations to opt out of automated decision-making that produces legal or similarly significant effects. None of the automated systems described above produce legal or similarly significant effects on users. If you have questions or concerns about any automated system, contact privacy@1st-bond.com.
The following features are available to all users at no cost unless otherwise stated:
Marketplace: browse and purchase listed items freely, or create listings to sell items (sellers must complete identity verification). See Section 11.
Meetup coordination: set a location, date, and time, generate a unique meetup code, share via SMS or in-app message. Reminders at 6 hours, 1 hour, and 10 minutes before your meetup.
GPS Navigation: built-in navigation with Fastest, No Tolls, and No Highways route options.
Live tracking: recommended departure time and the other party's ETA.
Pre-meetup confirmation scan: mandatory coordination and check-in step described in Section 3.3.
Optional identity verification: displays an "ID Verified" badge; required to create Marketplace listings as a seller.
Business Discovery: browse Business Profiles in the Directory view and view For You feed content in-app and on 1st-bond.com. Businesses may create a free Business Profile. See Section 13.
In-app messaging: direct messages between two users.
Ratings and reviews: after a completed meetup, either party may rate the other. Users may also rate Business Profiles. See Section 14.
User search: search for other users by name or @username.
Report and block: report or block other users from their profile or message thread.
Promoted Listings: one-time in-app purchase of promoted placement. See Section 12.
Business Directory Subscription: optional recurring subscription for enhanced Business Profile visibility. See Section 13.6.
Account management: change email, password, username; delete account; clear meetup history.
You agree to use the Services only for lawful purposes and in a manner consistent with these Terms.
The Services allow you to create, post, store, and share content including Marketplace listing titles, descriptions, and photographs; Business Profile information, photographs, and video; For You feed posts; profile photos and bios; and in-app messages (collectively, "User Content"). Except for the license you grant below, you retain all rights in and to your User Content.
By posting User Content, you grant 1STBOND LLC a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, distribute, display, and transmit that User Content solely for operating, providing, and improving the Services — including displaying your content in the app and on 1st-bond.com. This license ends when you delete the content or your account, subject to cached copies that may persist for a reasonable technical period.
By posting User Content, you represent and warrant that:
You own the User Content or have all necessary rights, licenses, and permissions to post it
Your User Content does not infringe any third party's copyright, trademark, patent, trade secret, privacy, publicity, or other intellectual property or proprietary rights
Your User Content is accurate and not misleading or deceptive
Your User Content does not violate any applicable law or these Terms
You may not post, upload, or share any User Content that:
Is unlawful, fraudulent, false, misleading, or deceptive
Is obscene, pornographic, or sexually explicit
Is harassing, threatening, abusive, or discriminatory on the basis of any protected characteristic
Infringes any third party's copyright, trademark, or other intellectual property — including video with unauthorized copyrighted music
Contains personal information of any third party without their consent
Promotes or facilitates illegal activity or prohibited items described in Section 8.3
Contains viruses, malware, or other harmful code
Is spam, unsolicited advertising, or content whose primary purpose is to drive traffic to an external website
Impersonates any person, business, or entity
Promotes pyramid schemes, multi-level marketing, or deceptive commercial practices
1STBOND LLC does not actively monitor all User Content and does not endorse any User Content. We reserve the right to remove any User Content at any time, with or without notice, for any reason, including content we believe violates these Terms, applicable law, or the rights of third parties. Removal does not entitle you to a refund of any paid features.
You may not create an account using false information, impersonate any person or entity, misrepresent your identity or age, or submit fraudulent identity documents. You may not create more than one account, or create a new account after being terminated or suspended.
You may not use the Services to harass, threaten, intimidate, stalk, or abuse any other user or third party.
Prohibited items and transactions include but are not limited to:
Controlled substances, illegal drugs, or drug paraphernalia
Firearms, ammunition, or weapons (including illegal modifications)
Stolen property or property with removed or altered serial numbers
Counterfeit, replica, or fraudulent goods
Recalled or hazardous items
Human body parts, blood, or bodily fluids
Government-issued documents, IDs, or licenses
Sexual services or content that facilitates human trafficking
Content that exploits or endangers minors
Food stamps, WIC vouchers, or other government assistance program instruments
Any item or service prohibited under applicable federal, state, or local law
You may not use any bot, script, scraper, crawler, or other automated means to access, collect data from, or interact with the Services without our prior written consent.
You may not submit false safety reports, misuse the report or block features, manipulate ratings or reviews, or attempt to circumvent the pre-meetup confirmation scan or seller identity verification requirements.
You may not disclose, share, publish, or otherwise distribute the personal information of another user obtained through your use of the Services.
ENFORCEMENT Any violation of Section 8 will result in immediate, permanent account termination without prior notice. We reserve the right to report violations to law enforcement. No refund or credit will be issued upon termination for cause.
In-app messages are visible only to the two parties in a conversation. Message content may be accessed by 1STBOND staff only for safety enforcement, violation investigation, or legal compliance. When a meetup code is shared in a message thread, a direct Join Meetup button is automatically generated within that thread.
You may report or block any user from their profile or an active message thread. Reports are reviewed by our team. 1STBOND LLC makes no representation regarding the speed, outcome, or effectiveness of any review. Blocking immediately prevents the blocked user from contacting you or viewing your profile.
To create a meetup, you enter a location, select a date and time, and generate a unique alphanumeric meetup code. You may share the code via SMS or in-app message. The meetup creation screen allows you to optionally enable the "Require ID verification" setting described in Section 3.4.
The scan window opens 6 hours before the scheduled meetup and closes 10 minutes before. Reminders are sent at 6 hours, 1 hour, and 10 minutes before. A completed scan confirms only that the device user matches the account that scheduled the meetup — it does not confirm identity, age, intentions, or safety of any party.
An Unverified meetup means at least one party did not complete the scan before the 10-minute window closed. It carries no other meaning. 1STBOND LLC bears no responsibility for outcomes of any meetup.
Built-in GPS navigation and live tracking are powered by Google Cloud Platform. 1STBOND LLC is not responsible for the accuracy of navigation directions, ETA estimates, or departure time recommendations. Opening the destination in a third-party mapping app passes your destination to that app, subject to its own privacy policy.
You may clear your meetup history at any time. Records are retained for up to 90 days per our Privacy Policy.
SELLERS MUST COMPLETE ID VERIFICATION To create a Marketplace listing, you must first complete identity verification through Didit. You may not create or maintain an active listing without completing verification. Buyers are not required to verify unless the seller enables the "Require ID verification" setting for a specific meetup.
Verified sellers may create listings including title, description, price, category, and photographs. You are solely responsible for listing accuracy. You represent you have the legal right to sell any item listed. Duplicate listings for the same item are not permitted.
1STBOND LLC does not process payments for Marketplace transactions. Any payment occurs entirely outside the platform between buyer and seller. 1STBOND LLC is not a party to any transaction and is not responsible for disputes, fraud, non-payment, or non-delivery. You are solely responsible for any applicable taxes arising from your transactions.
1STBOND LLC reserves the right to remove any listing at any time. You may remove your own listings at any time.
Business sellers must identify a natural person responsible for the account who completes identity verification. Businesses seeking a dedicated directory listing should refer to Section 13 (Business Discovery).
Promoted Listings are one-time purchases for a fixed duration. Current pricing and duration are displayed in the app at the time of purchase. Purchases are made via Apple App Store or Google Play. Apple and Google are solely responsible for billing, payment processing, and refund decisions. 1STBOND LLC has no control over their billing systems or refund policies.
Promoted Listings increase visibility but do not guarantee any sale or outcome. All refund requests must be directed to Apple or Google. If your listing or account is removed for a Terms violation during an active promotion, the promotion ends immediately with no refund for any unused portion.
The Business Discovery tab has two surfaces: (a) the Directory — Business Profiles organized by category and location; and (b) the For You feed — video and photo content posted by businesses. Both surfaces are free to browse. 1STBOND LLC does not endorse or guarantee any business listed.
Creating a Business Profile does not require identity verification. Any account holder may create one by tapping "+ List" in the Business tab. You represent that you have authority to act on behalf of the business you list. If you also create Marketplace listings, the mandatory seller verification in Section 11.1 applies independently.
"VERIFIED BUSINESS" BADGE — NOT AN IDENTITY VERIFICATION The "Verified Business" badge displayed on a Business Profile indicates that the business holds an active Business Directory Subscription (see Section 13.6). It is a paid subscription feature only. It does NOT mean 1STBOND LLC has verified the business's identity, legitimacy, licensing, ownership, insurance, or legal status, and it is not a background check, endorsement, or safety representation of any kind. This badge is entirely separate from the "ID Verified" badge described in Section 3.2, which reflects a natural person's completed government ID and biometric identity verification through Didit. Users should not rely on the "Verified Business" badge as an indicator of a business's trustworthiness, safety, or authenticity.
LEGAL BUSINESS ENTITY REPRESENTATION By checking the box confirming you operate a legal business and creating a Business Profile, you represent and warrant that: (a) you operate a legitimate, lawfully existing business or entity, whether a sole proprietorship, partnership, corporation, limited liability company, or other recognized legal form; (b) you have the legal right and authority to create, manage, and act on behalf of that business in connection with the Business Profile; (c) all information you submit — including business name, address or service area, category, hours, and contact information — is accurate, current, and not misleading; and (d) your business is not suspended, dissolved, revoked, or otherwise barred from lawfully operating under applicable federal, state, or local law. Misrepresenting your business's legal status or authority to act on its behalf is a violation of these Terms and may result in immediate removal of the Business Profile and termination of your account. 1STBOND LLC does not independently verify business registration, licensing, or legal formation status; this representation relies on your affirmative confirmation.
In addition to Section 7.4, For You feed content must:
Accurately represent your actual business — no misrepresentation of name, location, services, pricing, or brand affiliation
Not contain graphic violence, sexually explicit material, or content a reasonable person would find grossly offensive
Not contain unauthorized copyrighted music, footage, images, or other third-party IP — including background music in videos for which you do not hold a license
Not constitute spam — no repetitive posts of substantially the same content
Not promote prohibited items or services as described in Section 8.3
Not contain false or misleading advertising claims about your products, services, or pricing
Business Profile data is publicly visible in the app and on 1st-bond.com and may be indexed by search engines. By creating a Business Profile, you consent to this visibility. Upon deletion, data is removed promptly from 1STBOND; we are not responsible for third-party search engine caching.
1STBOND LLC does not control, endorse, or assume responsibility for any externally linked website in a Business Profile. Accessing a linked site is at your own risk and subject to that site's terms.
An optional recurring Business Directory Subscription provides enhanced visibility. Current pricing, features, and billing terms are displayed in the app and on 1st-bond.com at the time of purchase.
Auto-renews unless cancelled at least 24 hours before the end of the current billing period
Cancel via Apple App Store, Google Play Store account settings, or — for web purchases — through 1STBOND LLC's web checkout. Cancellation takes effect at end of current period
No partial refunds for unused portions of a billing period, except where required by law
Apple and Google are solely responsible for billing, payment processing, and refund decisions for app-based purchases; 1STBOND LLC has no control over their systems. For web purchases, contact support@1st-bond.com
Pricing changes require at least 30 days' advance notice to active subscribers
Does not guarantee any specific placement, views, inquiries, or business outcomes
Users may leave star ratings and written reviews on Business Profiles at any time, regardless of whether they have completed a meetup with that business. 1STBOND LLC does not verify review accuracy. Businesses may not manipulate, purchase, or coerce ratings or reviews; doing so violates Section 8.5 and may result in account termination.
1STBOND LLC may remove any Business Profile at any time. You may remove your own profile at any time. Removal does not entitle you to a refund of any Subscription fees paid.
After a completed meetup, either party may leave a star rating on the other user. Users may also rate Business Profiles. Ratings are publicly visible. You may not submit false, fabricated, or bad-faith reviews; reviews in exchange for payment or benefit; or reviews with an undisclosed conflict of interest. 1STBOND LLC may remove ratings that violate Section 7.4 but is under no obligation to do so. Ratings are not endorsements by 1STBOND LLC.
The Services, including all text, graphics, images, software, and other materials, are owned by 1STBOND LLC or our licensors and are protected by U.S. and international intellectual property laws. "1STBOND" and the 1STBOND logo are trademarks of 1STBOND LLC. Nothing in these Terms grants you any right to use our trademarks, logos, or trade dress without our prior written consent.
If you submit suggestions or feedback about the Services, you grant 1STBOND LLC a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation or compensation to you.
It is 1STBOND LLC's policy to respond to valid DMCA notices (17 U.S.C. § 512). To submit a copyright infringement notice, send a written communication to our Designated Copyright Agent containing:
An electronic or physical signature of the copyright owner or authorized person
Identification of the copyrighted work claimed to have been infringed
Identification of the allegedly infringing material, with sufficient detail to locate it (e.g., URL or screenshot)
Your name, address, telephone number, and email address
A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or applicable law
A statement under penalty of perjury that the information is accurate and you are the owner or authorized to act on their behalf

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing may be liable for damages including attorneys' fees.
In accordance with the DMCA, 1STBOND LLC will terminate the accounts of users determined to be repeat infringers of copyrights or other intellectual property rights.
The Services integrate with Google Cloud Platform (navigation and maps), Didit (identity verification), AWS (biometric storage), Sentry (error monitoring), and others described in our Privacy Policy. Your use of third-party services is subject to their own terms and privacy policies. 1STBOND LLC is not responsible for the practices, content, or performance of any third-party service.
Business Profiles may include links to external websites. 1STBOND LLC does not control, endorse, or assume responsibility for any externally linked site. Accessing a linked site is at your own risk.
When you open a meetup destination in a third-party mapping app, your destination address is transmitted to that application, subject to its own privacy policy. 1STBOND LLC is not responsible for how that data is handled by the third party.
By creating an account, you consent to receive electronic communications from 1STBOND LLC including meetup reminders, scan alerts, message notifications, and notices about these Terms or our Privacy Policy. You agree that electronic notices satisfy any legal requirement that such communications be in writing.
You may opt out of non-essential communications by adjusting notification settings in the app or on your device. You may not opt out of communications necessary to the operation of your account, including account security notices and material Terms updates.
IMPORTANT — PLEASE READ CAREFULLY 1STBOND is a marketplace, meetup coordination, and local business discovery platform. IT IS NOT A SAFETY SERVICE, IDENTITY VERIFICATION SERVICE, OR BACKGROUND CHECK SERVICE. THE SERVICES DO NOT VERIFY THE AGE, IDENTITY, CRIMINAL HISTORY, INTENTIONS, OR CHARACTER OF ANY USER, EXCEPT TO THE LIMITED EXTENT A USER HAS VOLUNTARILY COMPLETED OPTIONAL IDENTITY VERIFICATION, WHICH ITSELF ONLY CONFIRMS THAT A SUBMITTED DOCUMENT MATCHED A FACE SCAN AT A SINGLE POINT IN TIME. UI labels within the app (such as "Safe, verified in-person meetings") are simplified usability descriptions and are not legal representations. These Terms control. By using 1STBOND, you acknowledge and agree that: - In-person meetups with strangers carry inherent and significant risk that 1STBOND does not eliminate - 1STBOND does not independently verify the age of any user who has not completed identity verification - Optional identity verification confirms only that a government ID was matched to a face scan; not intentions, character, or criminal history - The pre-meetup confirmation scan is a coordination tool only, not a safety or identity verification feature - The presence or absence of an "ID Verified" badge is not a safety representation - An Unverified meetup status means only that the scan was not completed before the window closed - 1STBOND is not a law enforcement agency, security service, or emergency responder - You are solely responsible for your own safety during any in-person interaction BY USING 1STBOND, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH IN-PERSON MEETUPS, INCLUDING THE RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE, REGARDLESS OF WHETHER ANY PARTY HAS COMPLETED OPTIONAL IDENTITY VERIFICATION. If you are in immediate danger, call 911 or your local emergency services. Do not rely on 1STBOND.
To the fullest extent permitted by applicable law, you release 1STBOND LLC and its officers, directors, employees, agents, and licensors from all claims, demands, and damages arising out of or related to: (a) disputes between users; (b) any Marketplace transaction or in-person meetup; (c) any Business Profile content posted by a third party; and (d) the acts or omissions of any third party encountered through the Services.
California residents hereby waive their rights under California Civil Code § 1542, which provides: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor."
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 1STBOND LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; AND ANY WARRANTY REGARDING THE ACCURACY OF ANY CONTENT, INCLUDING MARKETPLACE LISTINGS, BUSINESS PROFILES, FOR YOU FEED CONTENT, RATINGS, IDENTITY VERIFICATION RESULTS, OR NAVIGATION DIRECTIONS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 1STBOND LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR ANY IN-PERSON MEETUP OR TRANSACTION ARRANGED THROUGH THE SERVICES.
IN NO EVENT SHALL 1STBOND LLC'S TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO 1STBOND LLC IN THE TWELVE MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless 1STBOND LLC and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or connected with: (a) your access to or use of the Services; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party right; (e) any Marketplace transaction or meetup you arrange; or (f) your violation of any applicable law.
1STBOND LLC may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our discretion. No refund will be issued upon termination for cause.
You may delete your account at any time via Settings → Account → Delete Account, or at https://1st-bond.com/delete-account. Data retention following deletion is governed by our Privacy Policy.
Accounts with no login activity for 24 consecutive months may be considered inactive. We may notify you by email before taking any action on an inactive account. Business Directory Subscription fees continue to accrue regardless of account activity until you cancel.
Sections 7.2, 7.3, 8, 11.3, 11.4, 12.2, 13.4, 13.7, 13.8, 14, 15, 16, 17, 18, 19, 20, 21, 22, 24, and 25 survive termination and remain in full force and effect.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Except for claims that qualify for small claims court, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. Arbitration shall take place in Denver County, Colorado, or by video conference if agreed. The arbitrator's decision is final and binding.
YOU AND 1STBOND LLC EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. All claims must be brought individually.
You may opt out of arbitration by emailing support@1st-bond.com within 30 days of first accepting these Terms, including your name, account email, and a statement that you are opting out. If you opt out, disputes shall be resolved exclusively in the state or federal courts in Denver County, Colorado.
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law provisions. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts in Denver County, Colorado.
These Terms and our Privacy Policy constitute the entire agreement between you and 1STBOND LLC and supersede all prior agreements.
If any provision is found unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions remain in full force.
Our failure to enforce any provision will not be deemed a waiver of that provision.
You may not assign your rights without our prior written consent. 1STBOND LLC may assign these Terms in connection with a merger, acquisition, or sale of assets.
1STBOND LLC will not be liable for failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, government action, power outages, or failures of internet infrastructure or third-party service providers.
